1. General Provisions
1.1 This anti-corruption standard has been developed in accordance with Article 10 of the Law of the Republic of Kazakhstan “On Combating Corruption” and is a system of prohibitions, restrictions and permissions in all areas of activity of the Abay Myrzakhmetov KU of the Ministry of Education and Science of the Republic of Kazakhstan (hereinafter - the University).
1.2 The purpose of the anti-corruption standard is to prevent corruption, increase legal literacy and zero tolerance for corruption in the activities of the University, its staff and management.
1.3 The objectives of the anti-corruption standard are:
- the formation of sustainable anti-corruption behavior and responsibility of the administration, faculty and employees of the University in the implementation of functional duties;
- timely detection of corruption and the prevention of their negative consequences;
- the development of anti-corruption culture among the employees of the University;
- improving the effectiveness of the University.
1.4 Application and implementation of the anti-corruption standard:
- The anti-corruption standard is applied in the activities of the University in the exercise of the functions and realization of the rights and legitimate interests of citizens, the University and its employees.
- The anti-corruption standard is mandatory for the University employees.
- For the application and implementation of the anti-corruption standard, each employee of the University is personally responsible.
1.5 The change in the anti-corruption standard is made in accordance with paragraph 2 of Article 10 of the Law of the Republic of Kazakhstan “On Combating Corruption”.
1.6 The Anti-corruption Standard defines the actions and decisions of the University employees aimed at strict observance of the established rules and the prevention of corruption.
1.7 Monitoring compliance by the University employees with the anti-corruption standard is carried out by the Ethics Commissions of the University and faculties.
1.8 Developer of the anti-corruption standard: Jurisprudence and the educational center for the educational part.
2. Rules of conduct (actions) of University employees
Prohibitions, restrictions, and permissions:
2.1 In the exercise of the rights and legitimate interests of the University and its employees:
2.1.1 do not accept in the exercise of their official powers any material goods, services or other privileges associated with the performance of their duties;
2.1.2 do not allow a conflict of interests, if they arise, take measures to eliminate them in accordance with the law;
2.1.3 do not use official position in the implementation of educational and other services in order to benefit for themselves or third parties;
2.1.4 cherish the business reputation of the university, refrain from participating in activities contrary to or damaging the rights and legitimate interests of the University, suppress any attempts to discredit its honor and authority;
2.1.5 prevent the unreasonable transfer of information about the personal data of University employees;
2.1.6 ensure the promotion of employees by observing the principles of meritocracy and on a competitive basis, taking into account such factors as knowledge, qualifications, experience, productivity and efficiency;
2.1.7 the rights of scientists to receive benefits from their original ideas, discoveries and inventions, as well as to profit from their implementation, must be protected by regulatory documents;
2.1.8 the University employees’ active participation in determining the development of science and education and technology.
2.2 In other relationships arising from the provision of educational, scientific and other services:
2.2.1 Strictly comply with the requirements of the Constitution of the Republic of Kazakhstan, the Labor Code of the Republic of Kazakhstan, the Laws of the Republic of Kazakhstan "On Education", "On Science", "On State Property", anti-corruption and other legislation of the Republic of Kazakhstan;
2.2.2 do not commit misconduct and other offenses for which the laws of the Republic of Kazakhstan provide for disciplinary, administrative or criminal liability;
2.2.3 do not use official and other information not subject to official distribution, in order to obtain or extract property and non-property benefits and advantages;
2.2.4 when fulfilling their official duties, observe business etiquette and the rules of official conduct, strictly comply with the Code of Corporate Culture of the teacher and employee of Abay Myrzakhmetov KU of the Charter and the Internal Rules of the University, other regulatory legal acts of the University.
3. Obligations of University employees in making managerial
and other decisions within its competence
3.1 Report to the immediate supervisor on the occurrence of a conflict of interest, personal interest in the performance of official duties, incline to corrupt behavior and receive gifts.
3.2 Do not be guided by personal and selfish interests in the performance of official duties.
3.3 Refrain from applying to colleagues and managers with unlawful requests that violate the established order of relations, which may affect their adoption of an impartial official decision.
3.4 Do not incite or encourage others to commit corruption offenses.
3.5 Do not give gifts to colleagues, managers and other officials and do not provide unofficial services for obtaining property benefits, benefits or advantages using official powers.
3.6 In connection with the performance of official powers, do not accept gifts.
3.7 Do not use official and other information not subject to distribution in order to obtain or extract property and non-property benefits and advantages.
3.8 Refuse from appointment if it is associated with direct subordination or control of persons in close family relationships (parents, spouses, brothers, sisters, children).
3.9 Be active in the fight against corruption, the disclosure of corruption offenses.
3.10 Immediately report to the management on the facts of corruption that have become known, as well as on the inclination to receive any benefit for expedited consideration of materials or red tape.
3.11 Immediately in writing to inform the immediate supervisor of doubts about the legitimacy of the order received for execution.
3.12 Turn to higher management if the immediate supervisor is himself involved in a conflict of interest.
3.13 Support and require colleagues to maintain a high legal and anti-corruption culture.
3.14 On an ongoing basis, take measures to eliminate the causes and conditions of a possible conflict of interest, corruption offenses and their consequences.
3.15 Refrain from representing or lobbying the interests of third parties, as well as taking actions on their behalf.
3.16 Do not use official position to influence the activities of colleagues and students in resolving issues outside the service;
3.17 Do not force others to commit corruption offenses.
3.18 Prevent and suppress violations of anti-corruption laws by subordinates and other officials.
3.19 Timely take comprehensive measures to resolve the conflict of interest that arose in colleagues in the course of fulfilling their duties.
3.20 Take comprehensive measures to prevent corruption.
3.21 Eliminate the causes and conditions conducive to the commission of corruption offenses, including with subordinates.
3.22 Do not allow involvement, including subordinates and students to perform unofficial or personal tasks.
4. Recommendations to the University employees in the provision of scientific, educational and other services
4.1 On an ongoing basis, take measures to improve the quality of the provision of educational, scientific and other socially significant services and to prevent bureaucratic barriers in the system of interaction "university - teacher - student"
4.2 Strive for professionalism, constantly improving knowledge, studying domestic and foreign experience and scientific achievements.
4.3 By professional and universal behavior, set an example for those around;
4.4 To serve students with a personal example of labor discipline, respectful and careful attitude to their university, its traditions, history.
4.5 Do not abuse authority in relation to students, do not allow prejudice against students and subjectivity in assessing knowledge.
4.6 Do not demean the dignity of colleagues and students, use obscene expressions, show familiarity and arrogance.
4.7 Do not distribute false information about the decisions of the University administration and the activities of its units.
4.8 Do not accept gifts or monetary rewards from students.
4.9 Prevent plagiarism and other academic irregularities.
4.10 Performing duties, show high culture, responsibility, integrity, academic honesty and objectivity, be guided by the principles of mutual respect, correctness, goodwill in relations with colleagues and students.
5. Recommendations to officials and employees of the University in public procurement related to the acquisition of goods, works, services
5.1 Optimal and efficient spending of funds used for public procurement.
5.2 Providing equal opportunities to potential suppliers to participate in the public procurement process, except as otherwise provided by law.
5.3 Ensuring fair competition among potential suppliers in accordance with the legislation on public procurement.
5.4 Openness and transparency of the public procurement process.
5.5 Prevent corruption.
5.6 Do not allow close relatives, spouse or relatives of the first leaders of this potential supplier and (or) the authorized representative of this potential supplier to take part in ongoing public procurement, who have the right to decide on the choice of supplier or who are representatives of the customer or public procurement organizer in ongoing public procurement .
5.7 Do not allow participation as a potential supplier and (or) a subcontractor (co-executor) involved by him who have unfulfilled obligations under executive documents and are included in the Unified Register of debtors.
6. Formation of an anti-corruption culture
6. Formation of an atmosphere of intolerance to corruption is an activity aimed at strengthening the conviction among all members of the university community of the need to counter any unfair practices. The university’s activities are carried out through a set of measures of a general educational, informational and organizational nature, which include:
6.1 Introduction of effective anti-corruption technologies and mechanisms in all areas of the university;
6.2 Implementation of the Code of Corporate Culture of faculty and staff, the Code of Honor of the student, the Regulations on the teacher and the Regulation on the student of Abay Myrzakhmetov KU
6.3 Conducting targeted work among members of the university community to ensure anti-corruption literacy of the public understanding of the danger of corruption of its consequences, the formation of persistent anti-corruption immunity, anti-corruption consciousness and anti-corruption culture;
6.4 Involving students, teachers and employees through social partnership in the process of preventing corruption;
6.5 Implementation of targeted programs for the education of students in the patriotism and active citizenship;
6.6 Conducting regular anti-corruption monitoring through mass opinion polls “University outside corruption”, “Teacher through the eyes of students”, “Teacher through the eyes of colleagues”, “Assessment of student satisfaction”, “Clean session”, “Support your KUAM”;
6.7 Ensuring wide access of the population to legal information of anti-corruption orientation on the Internet resource of Abay Myrzakhmetov KU
6.8 Organization of meetings with representatives of other state bodies and public associations, including the anti-corruption service, with the subsequent development of measures to combat corruption.
